bids&tenders™ Vendor Terms of Service Agreement
eSolutionsGroup Limited owns and operates bids&tenders™, a cloud-based Enterprise SaaS e-Procurement solution (an electronic bidding system) at www.bidsandtenders.ca. (the Site)
To create a bids&tenders™ Vendor Account, you must agree to the following terms and conditions by clicking on the "I accept" button at the bottom of this agreement. These Terms of Services (this Agreement) set forth the legally binding terms for your use of the Site as a Vendor. By clicking the "I Agree" button, you represent that you have the necessary authority to bind the Vendor and agree, on behalf of the Vendor, effective as of such date (the "Effective Date") to be bound by this Agreement.
Please read this Agreement carefully and save it for future reference, if you do not agree with this Agreement, you must discontinue use of the bids&tenders Site immediately and any continued use is unlawful and at your own risk.
1.1 "I", "We", "Us", "Our", "You" and "Your" means any person or entity applying to register a bids&tenders™ Vendor Account.
1.2 "Annual Subscription Fee" means a bids&tenders Annual Subscription that provides a Vendor, once payment is made, access to all Buying Organizations publicly bid solicitations for a period of one (1) year or two (2) years (depending on the Subscription Option selected by the Vendor) from the date of registration. This includes; the ability to register as a Plan Taker, Download Bid Documents, submit questions, receive electronic addendums and where electronic bidding is permitted by a Buying Organization, to submit a bid electronically. Also see " Pay-per Use" fee option.
1.3 "Bidder" means a person or entity who submits a bid in response to a Buying Organization
1.4 "Bid Documents" refers to the Bid document in paper or electronic form that contains Information for a Vendor to prepare and submit a bid or a response to a Buying Organization. Bid Documents include but not limited to: Bid Documents, Drawings, Addendums, etc.
1.5 "Bid Opportunity" means a summary in electronic form of the information relating to a solicitation by a Buying Organization and/or an advertisement or invitation, to Vendors to submit a bid, proposal, qualification or offer.
1.6 "bids&tenders™ Service" refers to the electronic bidding system service owned and operated by eSolutionsGroup Limited, which serves as the Electronic Bidding System for Buying Organizations and registered Vendors to facilitate the bidding process which includes but is not limited to; electronic notification, distribution and where available the electronic receipt of Bids.
1.7 "Buying Organization" means a bids&tenders Buying Organization that issues Bid Opportunities through the bids&tenders Site that include but are not limited to: government agencies, such as MASH Sector - Municipalities, Academic Institutions, School Boards, Health Regions and Publicly-Funded Post-Secondary Institutions, provincial, federal governments and agencies, government commercial/industrial agencies and any other public or private organization utilizing the Site.
1.8 "Commodity(ies)" means a system of words, numbers, or both, designed to identify and list goods, services and construction by classes and subclasses which the Vendor has selected during their bids&tenders Vendor Account registration process, that the Vendor requested to notified by email, when a Buying Organization publishes a public bid opportunity matching the commodity(ies) the Vendor has selected.
1.9 "Contact(s)" refers to the ability for Vendors during their bids&tenders Vendor Account registration process to add up to ten (10) additional staff contacts that have the authority to; download Bid Documents, acknowledge addendum(s), submit bids,edit and/or withdraw bids on the Vendor's behalf. The addition of a contact to a bids&tenders Vendor Account shall be deemed to be confirmation on behalf of the Vendor that such individual(s) has the authority to complete the foregoing actions on behalf of the Vendor, and to bind the Vendor to the terms and conditions contained in a Buying Organization(s) Bid Call Documents and any applicable Addenda.
Vendors are encouraged when creating a bids&tenders Vendor Account to invite additional contacts that you do want to have access to view, edit, submit and/or withdraw your bids on the Vendor's behalf, if you are on vacation or due to illness, etc, provided the contacts are not in direct competition for example (a company may have two divisions that could be competing for the same Bid Opportunity).
When creating a Vendor Account DO NOT invite additional contacts that you DO NOT want to have access to view, edit, submit and/or withdraw your bids or who may be in direct competition for example (a company may have two divisions that could be competing for the same Bid Opportunity).
1.10 "eSolutionsGroup" refers to eSolutionsGroup, that owns and operates the bids&tenders Service.
1.11 "Pay per Use Subscription" which provides a Vendor, access to one (1) publicly bid solicitation or invitational bid by an Buying Organization. This includes; the ability to register as a Plan Taker, Download Bid Documents, submit questions, receive electronic addendums and where electronic bidding is permitted by a Buying Organization, to submit a bid electronically. In the event that a Vendor selects "Pay-per-Use" fee and the Vendor does not submit a Bid or withdraws their Bid or the Buying Organization cancels the solicitation, the Vendor is not eligible to receive a refund.
1.12 "Plan Taker" means a Vendor who has registered as a Plan Taker for a solicitation with a Buying Organization and who has paid either the bids&tenders Annual Subscription fee or the Pay-per-Use fee, in addition to any additional fee that may be charged by a Buying Organization. As a condition of bids&tenders, each Vendor must first create a bids&tenders Vendor Account.
1.13 "Site" means a cloud-based Enterprise SaaS e-Procurement solution (an electronic bidding system) at www.bidsandtenders.ca.
1.14 "Vendor" refers to any person wishing to participate in the bidding process for contracts advertised on bids&tenders. Also refers to an individual or entity that has paid either an Annual Subscription fee or a "Pay per Use" Subscriber fee for the Service.
2. Vendor Payments and Fees
2.1 Vendors acknowledge and understand that by using the Site, they agree to the terms and conditions of the bids&tenders™ Payment Agreement, appended hereto Schedule 1.
2.2 In addition to those the terms and conditions of this Agreement and the bids&tenders™ Payment Agreement appended hereto as Schedule 1, Vendors wishing to participate in a Bid Opportunity may be required to qualify with a Buying Organization, to be eligible to participate in a Bid Opportunity.
3. Information Collected by bids&tenders
3.1 The information you provide during your participation in a Bid Opportunity is subject to the privacy policies of both the applicable Buying Organization(s) and bids&tenders™. You consent to the collection, use and disclosure of your personal information for the following purposes:
- to fulfill your bids&tenders™ Vendor account registration request;
- to contact you regarding your registration: to verify the information supplied by you; to allow you to make changes to your information; to confirm your registration;
- to grant you access to the Site and its content;
- to inform you of changes to the Service;
- to inform you of current and future Bid Opportunities, offers, news and events sponsored by bids&tenders™;
- to inform you of your renewal; to issue a payment receipt; to issue an invoice;
- to resolve disputes;
- to identify or troubleshoot problems;
- to detect and protect the Site and Service, the Buying Organization, and its agents and affiliates, against error, fraud and other illegal activity;
- to enforce this Agreement;
- for comparison and review to identify errors, omissions and accuracy; and/or
- as otherwise described to the Vendor at the time of collection, use or disclosure.
Any such contact may be made via email, mail, fax or telephone.
3.2 I/We authorize bids&tenders to make our information available to the public, other registered users and authorized users of the bids&tenders Service which includes but not limited to; our Company name, Contact person, address and contact information, at any time and in any format for the purpose of meeting the requirements of the bids&tenders Service. The Vendor's consent to this agreement and use of the Site is deemed the Vendor's consent to the processing of all personal information and its use by the bids&tenders Service or Buying Organization, including, but not limited to; the publication of Plan Taker information, the publications of Bidders information submitting bids, unofficial and official Bid amounts, and the selected Bidder(s) information, but excluding the provision of your name to other third parties for the purpose of mailing lists or any other purpose not related to the bids&tenders™ Service.
4. Change of Information
4.1 I/We agree that we are solely responsible for keeping our bids&tenders Vendor account information up to date which includes but not limited to; company name, company contacts, email addresses, telephone or fax numbers, street address, for the bids&tenders Service. I/We acknowledge that neither bids&tenders nor any Buying Organization shall bear any responsibility or liability for our failure to do so.
5. Basic Services Offered by bids&tenders
bids&tenders™ offers Vendors the following basic services;
5.1 Ability to create a bids&tenders™ Vendor Account. Only one account should be created for each Vendor. Do not duplicate a Vendor Account. If you forget your password, click on "Forgot Password" in the Vendor Account login area.
5.2 Electronic bid advertisement notification of public bid opportunities published by Buying Organization(s) that match the following information, that was selected by the Vendor when creating their bids&tenders™ Vendor Account:
- Commodity(ies) of goods, services and/or construction and,
- selected Buying Organization(s).
5.3 A Vendor can select to be notified of any or all of the Buying Organizations that publish a public Bid Opportunity. Buying Organization(s) are updated regularly and Vendors are automatically added to each Buying Organization as they are added.
5.4 Ability to add up to ten (10) additional staff Contacts that the Vendor authorizes to act on behalf of and ability to bind the Vendor to bid submissions with Buying Organizations.
5.5 Free preview (with water-mark) of the solicitation Bid Documents.
6. bids&tenders System Maintenance and/or Modifications
6.1 bids&tenders™ reserves the right, for any reason, in its sole discretion, to change, maintain or suspend the Site or Service with or without notice to Vendors. bids&tenders™ shall not be liable to any Vendor, in tort or in contract, should bids&tenders™ exercise its right to modify or maintain the Site or any aspect of any Service, including, but not limited to, content, features or hours of availability. bids&tenders™ may impose limits on certain features of any Service or the Site or restrict your access to part or all of any Service or the Site without notice or liability.
6.2 You agree that bids&tenders™ shall take commercially reasonable efforts to make its Site and Service available. However, bids&tenders™ is not responsible for any damages or losses related to any system errors or interruptions affecting its Site or any Service and the processing of any transaction related to any Service. You understand and acknowledge that the Site or Service may be unavailable unexpectedly as a result of circumstances beyond bids&tenders™ control.
6.3 In no event shall bids&tenders™ be liable for lost profits or any special, incidental or consequential damages arising out of or in connection with any Service, the Site or this agreement (however arising, including to the maximum extent permitted by law, it own negligence).
6.4 bids&tenders™ does not assume responsibility for reviewing or verifying the material, content and information on its Site and/or the Bid Opportunity or Bid Document information, or other information posted to the Site by Buying Organizations and is not responsible for any damages, losses, expenses or other injuries incurred by you or any other Vendor as a result of relying on any material, content and information posted on the Site.
7. Vendor Obligations and Conduct
Vendor represents, warrants and agrees that it will not:
7.1 conduct anti-competition, illegal, unlawful activities;
7.2 provide false or inaccurate information or misrepresent any personal or corporate information regarding your identity or intentions with respect to any matter;
7.3 directly or indirectly reverse engineer, decompile, disassemble or otherwise attempt to discover or derive the source code, object code or underlying structure, ideas, relevant to bids&tenders™;
7.4 post, publish, transmit, distribute, or upload any information through or link directly or indirectly any information to the Site that will harm bids&tenders™ , its Buying Organization or employees:
- send a virus or any other harmful software code intended to damage, detrimentally interfere with, expropriate any system, data or personal information;
- violate copyright, trademark or any other proprietary intellectual property rights of others.
7.5 use, reproduce, distribute, publish or communicate any information obtained from the Site, for any commercial reason, unless such activity has been expressly approved with the prior written approval by bids&tenders™ or the Buying Organization.
8. Bid Submission and Internet Traffic Jams
8.1 Bids&tenders advises the onus is on Vendors to ensure their Bid Submission, whether it be a paper based submission and/or an electronic bid submission (the allowable submission type(s) will be stated in the Buying Organization's Bid Document), is received no later than the closing time and date stated in the Buying Organization's Bid Document.
8.2 Vendors are cautioned, that where Electronic Bid Submissions are permitted by the Buying Organization, that the timing of their electronic Bid Submission is based on when the Bid is RECEIVED by the bids&tenders Bidding System, not when a Bid is submitted by a Vendor, as Bid transmission can be delayed in an "Internet Traffic Jam" due to file transfer size, transmission speed, etc. A Bid Submission will only be considered to have been submitted once it has been RECEIVED by the bids&tenders Bidding System and a confirmation email from the bids&tenders bidding system is received by the Bidder, confirming receipt by their electronic bid submission, regardless of when the Bid was submitted by the Vendor.
8.3 For the above reasons, bids&tenders recommends that Vendors allow sufficient time to upload their electronic bid submission and attachment(s) (if applicable) and to resolve any issues that may arise. The closing time and date for electronic bids submissions shall be determined by the bids&tenders Bidding System web clock.
9. Resolutions of Disputes between Buyers and Sellers
9.1 In the event of a disagreement between users of bids&tenders™, related to use of the Site, you agree to cooperate with bids&tenders™ staff to assist in resolution. bids&tenders™ expressly disclaims all liability and/or claims with respect to conflicts between Vendors and a Buying Organization.
10. Ownership and Use of Information
10.1 Any of the information received through the bids&tenders™ is owned by the Buying Organization that issued the information or bids&tenders™. The Vendor shall not use, store, copy, or reproduce the Information, or distribute or disclose it to any third party, except for the sole purpose of having such third party assist us in evaluating an opportunity or preparing a response to a Bid Opportunity. The Vendor shall not sell, distribute publish or otherwise disseminate to any third party, or make available for the purpose of resale to any third party, any Information received from or through the use of the Service without the prior written consent of bids&tenders™ and/or the applicable Buying Organization.
11. Confidentiality and Security
11.1 I/We acknowledge that bids&tenders™ cannot ensure the privacy and authenticity of any information that we send or receive through the Internet, and we agree that bids&tenders™ will not be responsible for any damages that we incur if we communicate confidential information to bids&tenders or Buying Organizations over the Internet, or if bids&tenders™ communicates such information to us at our request.
11.2 I/We agree not to disclose our bids&tenders™ login and/or password to any third party. We agree that we are solely responsible for all use of our login and/or password and we agree to put reasonable security procedures in place regarding its use and to notify bids&tenders immediately of any unauthorized use.
11.3 I/We agree that neither bids&tenders™ nor any Buying Organizations are under any obligation to confirm the actual identity or authority of any individual user or Vendor and/or password or any component thereof and have no liability for damages or harm we may incur from misuse, non-acceptance, delay or restriction in registration, receiving Information or Bid Components submitting responses to a Bid Opportunity, nor for any unavailability, malfunction, cancellation or withdrawal of online bid submission access or any portion of such service or any device associated with it.
11.4 Links to other Web sites or references to products, services or publications do not imply the endorsement or approval by any Buying Organization or bids&tenders™ of such Web sites, products, services or publications. bids&tenders™ is not responsible or liable for the content presented on these links including advertising claims, endorsements or names. These Web sites are not part of the Site or the Service and bids&tenders™ has no control over their content or availability.
12. Use of Internet and e-mail
12.1 I/We acknowledge and agree that if we access the bids&tenders™ Service through the Internet, we are responsible for reading and complying with any notices, warnings or disclaimers posted on the bids&tenders site or contained in linked Web sites.
12.2 I/We acknowledge and agree the fact that email is NOT a guaranteed delivery method and is subject to what is conventionally referred to as ANTI-SPAM filters that may impact the delivery of the email to our email account. We acknowledge that bids&tenders™ will not be responsible for an email once it has left bids&tenders™.
13. Changes to Service and Agreement
13.1 I/We acknowledge and agree that, from time to time, and at its discretion, bids&tenders™ may amend the provisions of the Service, including pricing or any of the terms and conditions of this Agreement (including Schedule 1).
13.2 Facts and information provided by bids&tenders™, including the Service, are believed to be accurate when placed on the Site. Changes may be made at any time to the material or information at the Site without prior notice.
13.3 bids&tenders™ is not responsible in any manner for direct, indirect, special or consequential damages, howsoever caused, arising out of use of the Site and/or Service, or the reliance on the information it contains.
14.1 I/We acknowledge and agree that bids&tenders™ may terminate this Agreement with us and suspend our use of the Service and access to the Site at any time and for any reason, including but not limited to limited to Vendors breach of this Agreement (including the terms and conditions outlined in Schedule 1).
14.2 In the event of Termination of this Agreement, bids&tenders™ will terminate your access to the Site which also includes, but not limited to; prohibiting a Vendor from further participation in a Bid Opportunity, despite the Vendor having already registered as a Plan Taker for such Bid Opportunity.
14.3 Upon termination, we acknowledge that our ability to register as a Plan Taker, download Bid Components, receive Addendum notifications and/or submit bids to Buying Organizations will be terminated.
14.4 I/We understand and agree that these terms and conditions will continue in force following termination. We acknowledge that all fees including but not limited to the Annual Subscription fee or the Pay per Use fee are not refundable.
The Vendor acknowledges and agrees that:
15.1 bids&tenders™ reserves the right to interrupt and/or suspend the use of the Site or Service and/or revoke the registration and activation at any moment in time through a routine notification, where possible, to the Vendor without incurring any liability;
15.2 the Site and Service are offered for use "as is," without any warranty or guarantee of any nature. The use of the Site and/or Service by the Vendor shall constitute a waiver of all warranty, specific or implied, including, by way of example and without limitation, the guarantee of compatibility for a specific use or scope;
15.3 the obligations undertaken by bids&tenders hereunder do not constitute and shall not be deemed an obligation to achieve any result;
15.4 bids&tenders™ does not guarantee the legal capacity and/or the good faith of any user of the Site or Service;
15.5 bids&tenders™ does not guarantee access to, truthfulness and completeness of, law-compliance and respect of third party rights by the contents of any web site to which users may be referred to through links inserted on bids&tenders;
15.6 Without prejudice to the provisions of the paragraphs and articles above, bids&tenders™ shall in no case be liable to any compensation for damages in excess of the Annual Subscription or Pay per Use Fee paid by the Vendor herein in relation to any claim for damages.
15.7 We agree that we will indemnify and hold harmless bids&tenders™ and its officers, directors, employees, agents and subcontractors for any loss, damage, cost, expense, liability or claim suffered or incurred as the result of our use of the Site or Service.
16. Laws of Application
16.1 We agree that this Agreement will be governed by the laws of the jurisdiction within which the Bid Opportunity is located.
17.1 We agree that bids&tenders™ may assign this Agreement, in whole or in part, without our consent, and we may not assign this Agreement in whole or in part.
18. Prior Agreements
18.1 We agree that this Agreement supersedes any prior versions of this Agreement governing the Site or Service.
19. Use of Information
19.1 The information contained on the Site and pages within is not intended to provide specific legal, procurement, accounting, financial or tax advice for any individual and should not be relied upon in that regard.
20. Software Backup
20.1 While every effort is made to ensure that all software provided at the Site is suitable for use on a wide variety of computer systems, you should take reasonable and appropriate precautions to scan for computer viruses, and ensure compatibility of the software with your specific computer system. You should also ensure that you have a complete and current backup of the information contained within your profile, bids&tenders™ is not responsible for keeping and maintaining your profile and submission data.
21. Trademarks belonging to bids&tenders or other Entities
21.1 Certain names, graphics, logos, icons, designs, words, titles or phrases at the Site may constitute trade names, trademarks or service marks of bids&tenders™, our Buying Organizations or other entities. Trademarks may be registered in Canada and in other countries as applicable. The display of trademarks on pages at this Site does not imply that a license of any kind has been granted. Any unauthorized downloading, re-transmission or other copying or modification of trademarks and/or the contents herein may be a violation of federal or common law, trademark and/or copyright laws and could subject the copier to legal action.
22.1 All Information at the Site is protected under the copyright laws of Canada and in other countries. In addition, certain information may be copyrighted by others. Unless otherwise specified, no one has permission to copy, redistribute, reproduce or republish in any form, any information found at this Site. Inquiries about permission should be directed to the bids&tenders at 1-800-594-4798
23. Unlawful Activity
23.1 bids&tenders™ reserve the right to investigate complaints or reported violations of this Agreement and to take any action we deem appropriate, including but not limited to reporting any suspected unlawful activity to law enforcement officials, regulators, or other third parties and disclosing any information necessary or appropriate to such persons or entities relating to your profile, e-mail addresses, usage history, posted materials, IP addresses and traffic information.
24. Canada's Anti-Spam Legislation
24.1 As of July 1, 2014, Canada's Anti-Spam Legislation requires that bids&tenders™ obtain your explicit consent in order for us to send you commercial electronic messages (CEMs). By agreeing to this Agreement you are providing consent for bids&tenders™ to send you email notifications of new public Bid Opportunities that match the Commodity Category(ies) and Buying Organization(s) you have selected when registering your bids&tenders Vendor Account, Addendum notifications, Bid Components, and other notifications during the bidding process.
25. Global Failure of bids&tenders or the Underlying Infrastructure
25.1 In the event of a Global Failure of bids&tenders™ or the underlying infrastructure, including but not limited to; "Force Majeure", the policy or procedures of the applicable Buying Organization shall apply and policy regarding reinstatement of the bidding process, where stated by the Buying Organization shall be abided by the Vendor.
25.2 Neither bids&tenders™ nor any Buying Organization shall have any liability for any damage to the Vendor as a result of the use or misuse, malfunction, delayed or failed access and/or interruption or suspension in the use of bids&tenders, including any indirect or consequential damage, such as lost commercial opportunities, missed earnings, loss of data, damage to company prestige, request for damages and/or claims from Third Parties, caused by:
a) "Force Majeure" including failure of power supply or telephone lines or network connection caused by any third party, strikes, industrial unrest, wars, government or civil or military reasons, embargoes, acts of vandalism and terrorism, epidemics, floods, earthquakes, fires and other natural disasters;
b) incorrect use of bids&tenders by Vendor;
c) flaws in the connectivity equipment used by Vendor; or
d) breakdown of bids&tenders information technology systems, telecommunications and/or computing equipment.
26.1 Vendor acknowledges that eSolutionsGroup Limited or another GHD controlled company ("Related Entity") may wish to respond to a Bid Opportunity and that nothing in this Agreement including the provision of the Services creates a conflict of interest or prevents eSolutions Group Limited or a Related Entity from submitting a proposal, quote or bid and being considered by a Buying Organization for said Bid Opportunity.
26.2 bids&tenders™ represents and warrants that the Services have not been designed or engineered in a manner so as to, nor will it operate to, provide eSolutionsGroup Limited or a Related Entity with any competitive advantage in responding to a Bid Opportunity.
26.3 bids&tenders™ acknowledges and agrees that the provision of the Services does not provide eSolutionsGroup Limited or a Related Entity with any favor or preference with respect to a Bid Opportunity nor does it obligate the Buying Organization to purchase any additional services from eSolutionsGroup Limited.
27. Support or How to contact Us
27.1 Should you have any questions or concerns about these Terms of Service, please contact the bids&tenders as detailed below.
27.2 bids&tenders will provide Vendor support via telephone or by email and is available 8:00am-6:00pm (EST), Monday to Friday. Emergency support outside of regular business hours is also available by telephone.
28.1 All communications pertinent to this Agreement shall be submitted via email to the main contact or contacts, the Vendor supplied during their Account registration process.
SCHEDULE 1 - bids&tenders™ Payment Agreement
I/We agree that the bids&tenders™ Vendor Account Agreement shall govern, in addition to the following terms.
I /We agree and understand that we are making payment for either;
1. Additional fee services offered by bids&tenders
Vendors shall not be eligible to participate in a public or invitational bid which includes; the ability to register as a Plan Taker, the ability to download original (not watermarked) Bid Documents, receive and download electronic addendum notifications, submit questions to the Buying Organization about the solicitation and where permitted by Buying Organizations, to submit and/or withdraw bids electronically, unless and until the Vendor purchases one of the following bids&tenders fee Options;
The following are the additional Fee Options assessed by bids&tenders™, as a Vendor, I understand and agree that I am paying for either;
Option 1: An "Annual Subscriber Fee": at $165 / year or Option 2: A Two (2) year Subscription Fee at $330 which both Subscription Options provides a Supplier; unlimited access/use to bids&tenders Buying Organizations Bid Opportunities, Bid Documents and to submit bids (electronic bid submission are only allowed, where permitted by the Buying Organization)
- I/We agree to register with the bids&tenders Service and acknowledge that payment of the Annual Subscriber Fee, is made in advance annually.
- I/We agree to pay any additional fees charged by Buying Organizations, where applicable, which may be in addition to this fee.
- I/We acknowledge and agree that bids&tenders may terminate or suspend our use of the bids&tenders Service for non-payment and that such termination or suspension will include but not limited to; suspension of, the ability to register as a Plan Taker, the ability to download Bid Documents, receive notification of and download Addendum(s) and to be able to submit a Bid or submit an Electronic bid, where permitted by the Buying Organization), despite being registered as a Plan Taker participation due to non-payment of Services.
- I/We agree all fees paid are final. bids&tenders is not obligated to refund or exchange fees paid.
bids&tenders has committed to maintaining this fee structure firm for three years (January 2016 to December 2018) Increments thereafter would be governed by Statistics Canada's Consumer Price Index (CPI) or not exceed 3%.
The annual subscription fee does not automatically renew. Vendors will be provided email advanced notice ninety (90) by bids&tenders to renew their subscription.
In the event of a Vendor's failure to renew your annual subscription fee, the Vendor acknowledges and understands that this failure will not permit the Vendor to further participate in a solicitation, despite having previously registering as a Plan Taker to a solicitation(s).
Option 3: A "Pay-per-Use" Fee: at $45 per bid provides a Supplier the access/use to a single Bid Opportunity, Bid Documents, and ability to submit a bid to that single Bid Opportunity (electronic bid submission are only allowed, where permitted by the Buying Organization). This option would be used if a Supplier only wanted to bid once per year.
- I/We agree that payment of the Pay-Per-Use is payment made to participate in a single Bid Opportunity of a Buying Organization, which may include, register as a Plan Taker, the ability to download the original (not watermarked) Bid Document and to submit a bid to that one Organization (electronic bid submissions are only permitted where allowed by the Organization).
- I/We agree to pay any additional fees charged by Buying Organizations, where applicable, which may be in addition to this fee.
- I/We agree all fees paid are final. bids&tenders is not obligated to refund or exchange fees paid which includes but is not limited to the following circumstances; the Vendor does not submit a bid or withdraws their bid or the Buying Organization cancels the solicitation, the Vendor is not eligible to receive a refund.
2. Method of Payment for above fees:
We agree to pay by valid credit card any "Annual Subscription fee" or "Two Year Subscription fee" or "Pay per Use" fees.
Upon ordering such services as stated above, you authorize bids&tenders to charge your valid American Express, MasterCard or VISA credit card for all charges when due.
3. Buying Organization(s) Fees:
As a Vendor, I understand and agree that additional Document Fees may be assessed by a Buying Organization(s), where applicable, which are in addition, to the above by bids&tenders™ fee(s), I/We understand and agree that some Buying Organizations, may require payment of this Document fee directly to the applicable Buying Organization to register as a Plan Taker and/or to obtain the Bid document and/or submit a bid to that Buying Organization (electronic bid submission are only allowed, where permitted by the Buying Organization).
